SenseWeb/SensorMap: Data Contribution Terms

This SenseWeb/SensorMap Data Contribution Terms (the “ Contribution Agreement”) describes the agreement between you (“You”) and Microsoft Corporation (“Microsoft” or “We”) for Your contribution of sensor data to Microsoft Research’s SenseWeb/SensorMap project (called “Project”). By contributing your sensor data to the Project, You agree to these terms.

1. Other Documents that Apply

   As a condition of participating in the Project, You acknowledge that You have read the Privacy Statement, Terms of Use and agree to the terms contained in those agreements (the “General Use Terms”), including but not limited to “Use of Services,” “Materials Provided to Microsoft or Posted at any Microsoft Web Site,” Microsoft’s disclaimer of warranties, and limitation of liability as to your use of, and contribution(s) to, the Project. To the extent that anything in this Contribution Agreement is different from the General Use Terms, what the terms of this Contribution Agreement governs with respect to the Project.

2. License Grant to Your Contribution

   You have control over the information and sensor data You put in the Project (Your “Contribution”). Microsoft does not claim ownership of Your Contribution. However, by contributing Your Contribution to the Project, You understand and agree that You are giving a license under Your intellectual property rights to all authorized users of the Project. In addition, You are giving Microsoft all the necessary rights to make Your Contribution available as part of the Project. You represent and warrant that: (i) you have the right to enter into this Contribution Agreement on behalf of the entity you represent, if any, and (ii) you own or otherwise control all of the rights to your contribution(s) as described in this Contribution Agreement including, without limitation, all the rights necessary for you to provide, post, upload, input or submit contributions.

3. No Endorsement/No Publicity

   Microsoft and You agree that inclusion of Your Contribution and Your participation in the Project is not an endorsement by Microsoft of Your technology, products and services. Either of us may mention Your name as a participant in the Project. Other than that, neither of us may generate a publicity release or other publicity information regarding participation in the Project without the other’s prior written approval.

4. Governing Law/Jurisdiction

   This Agreement is governed by the laws of the State of Washington. Both parties consent to exclusive jurisdiction and venue in courts sitting in King County, Washington. Both parties waive all defenses of lack of personal jurisdiction and forum non conveniens.
